3.    Promotional Period: The Promotion opens at 00:01 GMT on the 1^st September 2024 and closes at 23:59 GMT on the 30^th November 2024.  Entries made after this date to the Prize Draw promotion will not be accepted.

4.    Entry Instructions: Purchase is necessary to enter this Promotion; access to the internet, a valid email address and registration is required.  Only online participation via the webapp allowed.

4.1.           Participants need to purchase a promotional pack of Danone Kids Actimel 4-pack (Actimel Kids Strawberry and Banana or Actimel Kids Peach ). 

4.2.          Scan all 12 different Pokemon characters found on pack (12 bottles), and be in with a chance to win 1 of 250 prizes. Scan QR code on any promotional bottle to register details including first name, surname, confirmation of being over 18 years old and email address.

4.3.          Maximum of 1 entry per email address across the entire promotional period.

6.   Winner selection, notification & claim

6.1.           The 297 prize winners will be picked in a random draw using an independently supervised process from all entries received by the close of the promotion on 30th November 2024.

6.2.           The prize draw will take place on or before 16^th December 2025.

6.3.           Prize winners will be emailed at the email address used to enter the promotion within 7 days of the Prize Draw.

6.4.           The winners will be required to respond within 14 days confirming their acceptance of the prize and providing their name and address to receive the prizes by post.  

6.5.           In the event that a winner does not respond to this notification within 14 days, the Promoter reserves the right to select an alternative winner from all remaining entries, with the originally selected winner forfeiting their right to the prize.

6.6.           The winners of prizes should allow 28 days for delivery of this prize by Royal Mail or equivalent courier service from the date of the Prize Draw.

3. The prize draw will take place on or before 14th May 2025.
4. Prize winners will be notified by email (via the email address provided at time of entry into the promotion) within 7 days of the Prize Draw.

1. Winners will receive physical prizes such as the Sonic x Shadow Generations video game, Sonic Cable Guys Original Controller and Phone Holder and Sonic only Plush Box, via post.
2. The winner of the Tokyo trip prize will be contacted by the Promoter. 
3. By participating in the Promotion, entrants agree that the prize is awarded on an "as is" basis, and that neither the promoter nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prize.

THE TOKYO TRIP PRIZE: 

1. There will be one (1) prize consisting of a trip to Tokyo, Japan for up to two (2) adults aged eighteen (18) or over and two (2) persons aged seventeen (17) or under who must be accompanied by a parent or legal guardian (i.e., the winner and one (1) additional adult and two (2) persons aged seventeen (17) or under) (collectively, the “Recipient”) which consists of the following (the “Prize”):
   1. round trip economy flights (inclusive of all airport taxes, fees and /or duties) for the Recipients from the capital city of the country where the Recipients all reside to Tokyo, Japan;
   2. return airport to hotel ground transportation in Tokyo and a 72 hour Tokyo Subway pass;
   3. hotel accommodations consist of a four (4) night stay in a four (4) star Tokyo hotel in a family room, including breakfast. All Recipients to be lodged in a single room
   4. subject to each Recipient completing any applicable liability waiver forms required by the activity providers of the activities below and any other documents as requested by Octopi Promotions Limited (the “Travel Agent”) prior to the activities, and subject to any activity specific age/height restrictions, Recipients will participate in the following activities which will be held in English:
      1. A one day Sonic themed private guided tour of Tokyo including the activities listed in (b) to (e) below;
      2. A tour of Tokyo’s gaming district including evening passes to Tokyo Joypolis;
      3. One ride per person on the Thunder Dolphin rollercoaster;
      4. Return tickets on the Shinkansen “Bullet Train” between Tokyo and Yokohama;
      5. Tickets to Planetaria Yokohana including one VIP planet shaped bed;
      6. Lunch to the value of 25,000 YEN (total) at a Tokyo sushi restaurant;
      7. Tickets to Tembo Deck at Tokyo Skytree; and
      8. One 30 minute session at a hedgehog café 

 

TOKYO TRIP PRIZE CONDITIONS:

 

1.  the Recipients must travel at the same time with the same itinerary;
2.  Recipients must travel between 1st May 2025 and 31st May 2026. Travel is not permitted in July or August 2025 and between 15th December 2025 and 15th January 2026 and between 2nd –17th April 2026; 
3.  Recipients must provide the Travel Agent with at least ninety (90) days’ advance notice of travel date preferences and each Recipient must provide a copy of their passport to the Travel Agent in order to book the Prize;
4. once the Travel Agent has received signed booking forms, no changes will be permitted;
5. the Travel Agent will endeavour to accommodate the travel date preferences specified by the Recipients of the Prize, but all travel is subject to availability. Flights may be indirect and no stopovers or extensions to the trip are permitted. Recipients are responsible for travel to the airport in their home country. Activities referenced in section 30. iv herein are subject to availability at the time of booking and alternatives of equal or greater value may be offered, dependant on availability;
6.  Recipients must observe at all times the health and safety laws and regulations applicable to travel, hotel and activities. This may include, but not be limited to, testing requirements and/or proof of vaccination status. The Recipients shall be responsible for ensuring that they comply at all times with any such restrictions and/or requirements in order to redeem the prize.
7.  Accommodations for the Recipients includes breakfast. Any other meals, incidentals, gratuities, telephone calls or personal expenses not expressly included in the Prize and incurred during the trip will be the responsibility of the Recipients. A credit card for incidentals may be requested by the hotel at check-in and therefore at least one of the Recipients must possess and travel with a valid credit card;
8. The Prize is non-transferrable, non-changeable and non-refundable. Recipients cannot change, vary, substitute or extend any element of the Prize (in whole or in part). If Recipients are unable to take the Prize during the stated time period Recipients will forfeit the Prize with no compensation. Cash will not be awarded in lieu of the Prize;
9. if required, the Recipients must organise their own visas for travel to Tokyo, Japan and any transit countries. Travel Agent shall assist in the translation of visa application documents and certification of the travel itinerary where required. Any visa or passport charges are the responsibility of the Recipients. The Travel Agent and the promoter will not be responsible for the Recipients being unable to participate in the Prize due to visa or passport restrictions and no refunds or alternatives will be provided;
10. The Travel Agent shall assist with booking and pay for the cost of adequate travel insurance suitable for the needs of the Recipients if they are aged 64 or younger. The Travel Agent will provide a contribution towards the cost of travel insurance of £50 GBP per person for Recipients aged sixty-five (65) or older and/or those with pre-existing medical conditions for which the Travel Agent is unable to procure travel insurance coverage. In such a case the Recipient must organise their own suitable travel insurance cover and send the Travel Agent a copy of their travel insurance documents before they travel;
11.  Anything not specified as being included in these terms and conditions as being included in the prize package is excluded. In particular (but without limitation) the prize does not include expenses, spending monies, meals other than as stated, the cost of travel to the airport in the Recipients home country, and transfers other than those stated;
12.  Recipients travel at their own risk and, if for any reason any aspect of the Prize is not capable of running as planned, including war, terrorism, state of emergency, pandemic, or any other kind of disaster, tampering or computer virus, the Travel Agent reserves the right to substitute or modify the Prize, subject to any written directions from a relevant regulatory authority.
13. Children must be 130 cm or taller to ride the Thunder Dolphin rollercoaster and aged 4 or older to touch a hedgehog. There are minimum height requirements for certain rides at Tokyo Joypolis and some of the  games and rides are not suitable for those with motion, light, sound of other sensitivities. The Planetaria is suitable for children aged 4 and above. 

LIABILITY:

 

1.  The Promoter does not exclude or limit its liability for any matter for which it would be illegal to exclude or attempt to exclude liability, including for death or personal injury caused by its negligence, or for fraud or fraudulent misrepresentation. The Promoter accepts full liability for these matters and any other matters for which it cannot, under English law, exclude or limit its liability. References to the "Promoter" include all associated companies, agents, or third parties involved in the Promotion.
2.  Subject to the above, the Promoter will not be liable for:
3. Any cancellation, modification, or postponement of the Promotion due to events beyond the Promoter’s reasonable control;
4. Changes to prizes or their availability;
5. Issues related to the dispatch or delivery of prizes (e.g., prizes not reaching the winner due to incorrect delivery information or postal delays);
6. Any costs, taxes, fees, or other expenses related to the prizes that winners may need to cover;
7. Acts or omissions of any third-party suppliers involved in the Promotion. The Promoter does not accept responsibility for network, computer, hardware, or software failure of any kind, which may affect the sending, receipt, or processing of your entry.
8. The Promoter is not responsible for any technical, network, hardware, or software failures that may affect the sending, receipt, or processing of entries.
9.  If the Promotion is disrupted or unable to run as planned due to events beyond the Promoter's control, including but not limited to computer viruses, technical failures, or tampering, the Promoter reserves the right to cancel, terminate, modify, or suspend the Promotion, or to disqualify any affected entries, subject to applicable law.
10. The Promoter’s decision is final and binding in all respects on all entrants. Any correspondence entered into is at the discretion of the Promoter. Entries that do not comply in full with these terms and conditions will be disqualified. Incomplete entries will be disqualified and will not be counted. The Promoter is not obligated to inform the entrants who have entered such entries of such disqualification.
11.  Entries made through agents, third parties, or automated means will be disqualified. Incomplete, illegible, or fraudulent entries will not be counted. If it is found that an entrant has used software or any other automated method to repeatedly enter, that entrant will be disqualified, and any awarded prize will be void.
12.  The Promoter reserves the right to verify the validity of entries and entrants. If the Promoter suspects that an entrant has engaged in cheating, deception, or fraudulent conduct, the Promoter reserves the right to disqualify that entrant from the Promotion.
13. The Promoter reserves the right to modify, cancel, terminate, or suspend the Promotion, wholly or in part, at its sole discretion, if the Promotion cannot be conducted as planned due to circumstances beyond its reasonable control, including but not limited to unauthorised human intervention, fraud, or technical failures.
14. The Promoter is not responsible for any losses, delays, or disruptions caused by events beyond its control, such as supplier defaults, natural disasters, or other unforeseen circumstances that may impact the Promotion or the delivery of prizes.
15.  Any entrant who attempts to undermine the Promotion or engage in behaviour that is contrary to the spirit of the Promotion, such as tampering, hacking, or using unfair practices, will be disqualified at the Promoter’s sole discretion. If such actions significantly impair the Promotion, the Promoter reserves the right to take appropriate measures to ensure the fairness and integrity of the Promotion.

2.  Personal data which is provided by entrants on entering the Promotion will be processed and stored in a joint database accessed by the Promoter and any third party appointed for the purpose of managing entries to the Promotion.  By providing personal information, entrants consent to the processing and storage of personal information by the Promoter for this purpose.  
3.  By entering the Promotion, the winners agree to the processing of their personal data by any appointed third party for this purpose.  All data will be handled in accordance with any appointed third party’s privacy policy, to be shared with all prize winners.

 

GENERAL

 

1. There is no cash alternative to the prizes, and prizes are not transferable or exchangeable for other items or benefits. The Promoter reserves the right to substitute a prize of equal or greater value in the event of unforeseen circumstances.
2.  If the fulfilment of the Promotion or any prize is delayed or affected due any resulting government restrictions, affected entrants will be notified and kept informed of any unavoidable changes to the Promotion or prizes.
3. These terms and conditions are governed by the laws of England. Any disputes will be resolved exclusively in the courts of England.
